Can a Child Arrangement Order be discharged or varied? 

Yes, the court does have the power to vary or discharge its orders. However, the court will only do so under limited circumstances.    

Furthermore, you are entitled to seek an alteration or the discharge of an existing Child Arrangement Order either in part or in its entirety.

When will the court discharge a Child Arrangement Order?

The court has the power to vary or discharge its orders where circumstances change and the child’s interests require it. In such cases, the court’s primary consideration is the welfare of the child.

The court will consider whether one of the traditional grounds for review has been established; these include:

• Any fraud, mistake or misstatement of the facts on which the original order was made.
• Any Non-disclosure of important facets of the matter.
• Any new event or circumstance that invalidates the basis, or fundamental assumption on which the order was made.
