Why should I obtain a Clean Break Order?

In the UK, the Final Order will bring your marriage to an end. However, it will not sever all financial liabilities between the parties: even after you are divorced, either party can still bring a claim against the other. This can even apply to a windfall gained after the marriage has ended.

The only way to avoid a future claim is to obtain a court order which severs all legal ties and obligations. In these situations, you can apply for a Clean Break Order.

How does a Clean Break Order work?

The allocation of household assets and finances can prove one of the more complex aspects of a divorce. Not least because there is not always a guarantee that further claims may be made against you some time in the future.
